NCAA Not Covered by Title IX

Recently, in the midst of March Madness, the NCAA dropped the ball and provided the women’s tournament with unequal facilities, like weight rooms, as compared to the men’s tournament. A few inquires questioned whether the NCAA’s lack of equal access to training facilities violates Title IX.

This issue was litigated over 20 years ago. Title IX only applies to federal funding recipients and not to organizations made up of federal funding recipients like the NCAA. See National Collegiate Athletic Association v. Smith, 525 U.S. 459 (1999).

Interesting side note, Chief Justice Roberts argued this case on behalf of the NCAA in front of the Supreme Court when he was a practicing attorney.
